These Terms and Conditions set out the rules for using the Store and for concluding sales contracts between the Seller and the Customer.

2. Definitions

  • Customer - a natural person, legal entity or organisational unit placing an order in the Store.
  • Consumer - a natural person entering into a contract not directly related to their business or professional activity.
  • Product - goods offered for sale in the Store (New Balance safety and occupational footwear and related items).
  • Order - the Customer’s declaration of intent aimed at concluding a sales contract for a Product.

3. General provisions

Products sold in the Store are safety and occupational footwear (personal protective equipment) that comply with the relevant standards, in particular EN ISO 20345 (safety footwear) and EN ISO 20347 (occupational footwear). Protection classes and technical data are stated on each product page.

To use the Store, the Customer needs a device with internet access and a current web browser. Prices and product information do not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.

4. Orders and conclusion of the contract

Orders can be placed 24/7 via the Store. To place an order, add Products to the cart, provide the required delivery and billing details, choose a delivery and payment method, accept these Terms and confirm the order with the “Place order” button (an order with an obligation to pay).

The sales contract is concluded when the Customer receives an order confirmation by e-mail.

5. Prices and payment

All prices are shown in euro (EUR) and include applicable VAT (gross prices). Prices do not include delivery costs, which are shown separately before the order is confirmed.

Available payment methods include online card payment and other methods provided by our payment processor (Stripe). The Customer should pay for the order at the time of purchase. We begin processing the order after payment is received.

6. Delivery

Products are delivered within the European Union. Delivery costs and estimated times are shown during checkout. The standard delivery charge is EUR 9.90; delivery is free for orders of EUR 250 or more. Orders are usually dispatched within 1-3 business days.

7. Right of withdrawal (returns)

A Consumer may withdraw from the contract within 14 days of receiving the Product, without giving a reason. To do so, send an unequivocal statement (e.g. by e-mail to [email protected]) before the deadline expires. Details and the return procedure are described in our Refund and Returns Policy.

The Consumer should return the Product within 14 days of withdrawal. We refund all payments received, including standard delivery costs, within 14 days, using the same payment method used for the purchase. Returned Products should be unworn and complete.

8. Complaints and statutory conformity (warranty)

The Seller is obliged to deliver Products free from defects and in conformity with the contract. If a Product is not in conformity with the contract, the Customer has statutory rights under applicable EU and Polish law. Complaints can be submitted by e-mail to [email protected], describing the issue and the order details. We will respond within 14 days.

9. Out-of-court dispute resolution

A Consumer may use out-of-court means of handling complaints and pursuing claims. In particular, the European Commission’s Online Dispute Resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr.

10. Personal data

The controller of Customers’ personal data is ULVEN Michał Holc. Data is processed in order to perform the contract and fulfil legal obligations. Full information is available in our Privacy Policy.

11. Final provisions

In matters not regulated by these Terms, the generally applicable provisions of Polish and EU law apply. We may amend these Terms for valid reasons; changes do not affect orders placed before the change takes effect.
